Terms of Service

These Terms of Service (the “Terms”) form a legal agreement between you and Levin Schwab (Germany) (“we”, “us”, the “Developer”) governing your use of the FormatFox iOS application (the “App”). By downloading, installing or using the App you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement (Apple’s standard EULA). You may not copy, modify, reverse-engineer, decompile, distribute, sell, or sublicense the App except as permitted by applicable law.
2. In-App Purchase — FormatFox Pro
The App is free to download and includes a useful free tier. The App offers a single, optional in-app purchase, FormatFox Pro, which is a one-time, non-consumable purchase priced at €4.99 (or the local-currency equivalent set by Apple). FormatFox Pro is not a subscription: there is no recurring billing and nothing auto-renews. The purchase permanently unlocks the Pro features (such as batch conversion, audio transcode, quality control, EXIF preservation, the Share Extension, and removal of ads) for your Apple ID, and can be restored on your devices via the App’s “Restore Purchases” function.
All purchases are processed by Apple through the App Store and are subject to Apple’s terms and payment policies. We do not receive or store your payment details. Refunds are handled by Apple in accordance with its policies; please contact Apple Support for purchase or refund issues.
3. Acceptable Use
You agree to use the App only for lawful purposes and only on content that you own or are authorized to process. You are solely responsible for the files you convert and for keeping your own backups. You must not use the App in any way that violates applicable law or the rights of others.
4. Privacy
The App processes your files entirely on your device and does not collect or upload your content. For details on the limited advertising data handled for free-tier users, see our Privacy Policy, which is incorporated into these Terms by reference.
5. Intellectual Property
The App, its design, code, and the “FormatFox” name and marks are owned by the Developer and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding. You retain all rights to the files you process with the App.
6. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that conversions will always preserve quality or be free of defects. You use the App at your own risk and are responsible for verifying converted output and maintaining backups of your original files.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, files, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the App shall not exceed the amount you actually paid for the App (if any) in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intent, gross negligence, or injury to life, body, or health.
8. Changes to the App and Terms
We may update the App and these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rights of your country of residence remain unaffected.
